TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing or using the CQS Performance mobile application and website at cqsperformance.com (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. DESCRIPTION OF SERVICE

CQS Performance is a digital training companion for firearm practitioners. The Service allows users to log drill results, track performance metrics, manage weapon configurations, view analytics, and participate in community features such as leaderboards and activity feeds.

3. ACCOUNT REGISTRATION

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. ACCEPTABLE USE

You agree not to:

• Use the Service for any unlawful purpose
• Submit false, misleading, or fraudulent training data
• Upload offensive, harmful, or inappropriate content to the media gallery or social features
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Impersonate another person or entity
• Use automated means to access or scrape the Service
• Harass, threaten, or intimidate other users through social features

5. USER CONTENT

You retain ownership of content you submit to the Service, including drill results, media, and profile information ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content as necessary to provide the Service.

For social features (leaderboards, activity feeds), you grant us permission to display your username, performance data, and shared content to other users of the Service.

6. INTELLECTUAL PROPERTY

The Service, including its design, logos, text, graphics, software, and all other content created by CQS Performance (excluding User Content), is our property and is protected by copyright, trademark, and other intellectual property laws.

The CQS Performance name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use them without our prior written permission.

7. TRAINING DISCLAIMER

Important: CQS Performance is a training data tracking tool only. The Service does not provide firearm safety instruction, tactical training, or professional guidance.

• Always follow all applicable firearm safety rules and local laws
• Always train under qualified supervision when appropriate
• The Service is not a substitute for professional firearm training
• Performance metrics and rankings are for personal tracking purposes only

We are not responsible for any injury, damage, or loss arising from firearm use or training activities, regardless of whether the Service was used to track such activities.

8. SERVICE AVAILABILITY

The Service operates on an offline-first architecture and is designed to function without an internet connection. However, certain features (cloud sync, leaderboards, social features, media uploads) require connectivity. We do not guarantee uninterrupted access to cloud features and may perform maintenance or updates at any time.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, CQS Performance and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

10. INDEMNIFICATION

You agree to indemnify and hold harmless CQS Performance from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. TERMINATION

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time from within the app under Settings > Danger Zone. Upon account deletion, your data will be permanently removed from our servers.

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
